Suspended bays

A suspended bay without formal authorisation (BS05191)
The appellant was issued with a PCN for being parked in a suspended bay/space or part of a bay/space and appealed on the ground that the suspension was not apparent. The Adjudicator ruled that a bay may only be suspended by statutory provision, including an Act, order, regulation, bylaw or notice. The council indicated that the bay had been suspended on the request of, and for the convenience of, another resident. However, in the absence of any relevant authorisation produced by the council, no contravention was established.
The appeal was allowed.
